01 About these terms

These terms apply to this website and to orders placed with Pastry is Art, a bakery cafe at 12591 Biscayne Blvd, North Miami, FL 33181. By using the site or placing an order you accept them.

02 Using this website

You may browse the site, share it and use it to contact us. You may not copy our photos, text or designs for commercial use, attempt to interfere with the site, or use it to send us unlawful or abusive content.

03 Quotes, prices and availability

Prices shown on this site are a reference and can change. Custom work is always quoted individually, based on size, design, decoration and date. A quote is valid for the date and the design it describes, and becomes an order when it is confirmed and the deposit is paid (for a delivery order, the full payment).

Menu items, flavors and seasonal products are subject to availability.

04 Custom design work

Every cake is made by hand. Before production starts, the client reviews and approves the design, and understands that the final product may have slight variations from the reference, since it is a hand-made product. Small differences in shade, height, flowers and finishing are part of that work.

Photos, sketches or references you send are used as inspiration, and the result is our interpretation of them, not an identical copy.

If you ask us to reproduce a logo, a character or artwork owned by someone else, you confirm that you have the right to use it for your private event, and you are responsible for that use.

05 Our design apps

We are building apps that let customers design their own cake, cookies, cupcakes and cake pops. They are not available yet, and the buttons on this site that mention them are marked as coming soon. When they launch they will have their own terms, which will be published before you can place an order through them.

06 Photos and intellectual property

The Pastry is Art name, logo, website and the photos of our work belong to us.

Unless otherwise stated by the client, the client grants Pastry is Art permission to photograph the cake and use the images for marketing and promotional purposes. If you prefer that we do not publish photos of your order, tell us when you place it and we will not.

07 Food safety and allergens

Our cakes and desserts may contain, or come into contact with, common allergens such as dairy, eggs, wheat, soy, nuts and gluten, and equipment is shared, so we cannot guarantee that any item is allergen free. The client accepts full responsibility for informing their guests of potential allergens.

Our products are fresh and are best consumed on the date agreed. Storage and handling after pickup or delivery are the client’s responsibility, following the instructions in our Refund Policy.

08 Pickup and delivery

Pickup is at our Biscayne Blvd location during business hours. Delivery is available across South Florida and is quoted with your order. Someone must be available to receive the order at the address and time agreed.

Cakes should be transported on a flat surface. Fondant cakes should be kept in a cool, air-conditioned environment, away from direct sunlight and heat; buttercream cakes must be refrigerated and brought to room temperature 1–2 hours before serving.

Once the cake has been picked up or delivered and accepted, Pastry is Art is no longer responsible for any damage that occurs.

09 Payment and taxes

A non-refundable deposit of 50% is due at booking to secure your order. For pickup orders the balance is due when the cake is ready, on the scheduled pickup day; delivery orders are paid in full when you book, and the first 50% is the non-refundable deposit. Failure to pay the balance of a pickup order by the applicable deadline may result in cancellation of the order without refund of the deposit.

Payments are processed by our ordering provider and by the payment terminals at the bakery. Prices do not include applicable sales tax unless stated. Cancellations and refunds are covered in our Refund Policy.

10 Third-party services

This site links to our ordering provider, to map services and to our social media profiles. We are not responsible for the content or the terms of those services.

11 Accuracy of the site

We keep this website as accurate as we can, but descriptions, prices and photos may contain errors or become outdated, and photos are illustrative. If something on the site is wrong, the quote we give you in writing is what applies to your order.

12 Limitation of liability

The client agrees to hold Pastry is Art harmless from any responsibility for damages or losses that occur after the cake has been picked up or delivered and accepted.

To the extent permitted by law, our responsibility for any claim related to an order is limited to the amount paid for that order. We are not responsible for indirect losses, such as costs related to your event.

13 Governing law

These terms are governed by the laws of the State of Florida, and any dispute will be handled in the courts of Miami‑Dade County, Florida.

14 Changes to these terms

We may update these terms. The version published on this page at the time of your order is the one that applies to it.
